SCOPE OF APPLICATION
The general terms and conditions shown here (hereinafter: "T&C") apply to all orders and purchases of clothing products and accessories (hereinafter: "Products") on the website www.indigosrl.it (hereinafter: "Website") operated by inDigo Surl (hereinafter referred to as Indigo), with offices in Corso Italia, 33 74015 Martina Franca (Ta) and by persons residing in countries where the Website is or will be active (hereinafter: " Customer").
The Customer is required to read the T&C carefully before making any purchase order.
By accepting the T&C and sending an order, the Customer declares:
to have read, understood and fully accepted the T&C;
to be a consumer and to purchase the Products exclusively for personal use and not to resell them in the context of a commercial or business activity of any nature;
to authorize Indigo to store, process, use and transfer to third parties and / or abroad the (personal) data contained in the order in order to perform the same.
Indigo does its best to ensure that the information contained on the Website is accurate and up to date. However, it is not possible to offer guarantees in this regard. The Customer acknowledges and accepts that the Products may not be fully compliant with the indications, specifications and / or photographs on the Website.
The sales contract between Indigo and the Customer is to be considered completed by sending the Customer the confirmation of the purchase order to the e-mail address indicated by the latter.
Indigo will consider any request for cancellation of order received by Indigo before the shipment of the Products to the Customer.
In the event that a certain Product present in the Customer's order is no longer available, Indigo will have no obligation to supply the Product in question, but will only be obliged to promptly inform the Customer of such circumstance. Should only a part of the Products indicated in the order be available, Indigo will contact the Customer to ask him if he intends to cancel the order or is willing to receive only the available Products.
Indigo reserves the right to reduce, at its discretion, the quantity of Products that can be purchased on the Website.
The prices of the Products, expressed in Euro will in any case be those indicated on the invoice. Indigo will, however, do its best to ensure that the prices indicated on the website are correct and updated.
Shipping and delivery costs will be charged to the Customer upon purchase of the ordered Products. Based on the shipping rates shown on the website.
Payment will be made by the Customer upon confirmation of shipment by credit card or in the other ways indicated in the relevant section of the Website.
The delivery of the Products will be made to the delivery address indicated by the Customer in the order.
In principle, the Products will be delivered within 7 (seven) days from the order confirmation by Indigo, provided that delivery times may vary depending on strikes or force majeure. In the event that delivery is delayed for reasons not attributable to Indigo, the Customer will be notified, as far as possible, of the new delivery date.
Indigo reserves the right to refuse, suspend or cancel, at its own discretion, the delivery or fulfillment of any of the obligations deriving from the sales contract, in the event of alleged fraud, default or breach by the Customer of obligations assumed towards Indigo with previous orders and / or sales contracts.
The reimbursement of the amounts paid by the Customer will always be done exclusively in favor of the Customer
RIGHT OF WITHDRAWAL (REFERENCE TO LEGISLATIVE DECREE 185 OF 22.05.99)
The Customer has the right to return the Products purchased on www.indigosrl.it, without the charge of any penalty and without being required to give reasons, within ten (10) calendar days from the day of receipt by the Customer of the Products in question.
With the receipt of the Products by Indigo, the sales contract will be considered canceled for all purposes and all the related obligations, rights or claims will lapse, provided that if the Products returned to Indigo are damaged, Indigo shall have the right to compensate such damage with the payment of the Products already made by the Customer.
In addition to the above (articles 15-16), the right of withdrawal is subject to the following conditions:
Within ten (10) calendar days from the date of receipt of the Products by the Customer. the Customer must contact Indigo customer service - by calling 800 75 79 77 or by sending an e-mail to email@example.com - in order to obtain authorization to proceed with the return ("RMA");
After receiving the RMA, the Products must be returned to Indigo, at the risk and at the expense of the customer, with a single delivery by courier or registered mail within 2 (two) days from the receipt of the RMA to the following address:

it is required to indicate visibly on the return parcel both the recipient inDigo S.u.r.l. that the RMA code, in order to avoid loss
the returned Product must not have been used, consumed, or damaged;
the identification tag of the Product must still be attached to it;
the Product must be returned in the original packaging, with any accessories or instruction manuals;
As soon as it is able to confirm that the conditions have been met, Indigo will send the Customer an e-mail confirming the acceptance of the return and will initiate the refund procedure so that the Customer receives a refund of the amount paid for the Products returned within the following thirty (30) days, regardless of the payment method previously adopted by the Customer.
The reimbursement of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment.
In the event that the above conditions have not been met, the Customer will not be entitled to a refund of the amount paid to Indigo.
The Customer will however only have the right to have the returned Products returned to him, at his own risk and at his own expense. If the Customer does not request to return the returned Products within thirty (30) days of the relevant communication by Indigo, Indigo shall have the right to retain them together with the amount received in connection with the transaction.
WARRANTY AND LIMITATION OF LIABILITY
Indigo's warranty is limited to any manifest defects in the Products.
The guarantee only gives the right to obtain reimbursement of the amount paid for the defective Products, provided that the defect is communicated to Indigo within 1 (one) month from when it was found.
In addition to the above, the right to reimbursement is subject to the following conditions, under penalty of forfeiture of the guarantee:
Before returning back the defective Products to Indigo, the Customer must contact Indigo's customer service by calling 800 75 79 77 or sending an e-mail to firstname.lastname@example.org to have the authorization to proceed with the return ;
The defective Products must be returned to Indigo, at the risk and expense of the Customer, by courier or registered mail within ten (10) calendar days from the date on which the Customer received the RMA return form from Indigo.
Once the Product has been received and the defectiveness of the Product has been verified, Indigo will send the Customer an e-mail confirming the acceptance of the return and will initiate the refund procedure for the Customer of the price paid for the defective Product which must be completed within thirty (30) days, regardless of the payment methods adopted by the Customer previously. The reimbursement of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment.
Without prejudice to the aforementioned guarantee, Indigo excludes any and all liability (contractual or non-contractual) towards the Customer, within the limits of the applicable mandatory regulations.
The maximum limit of overall liability to Indigo shall in no case exceed the amount paid by the Customer for the purchase of the Product.
In the event that one or more provisions of these T&C should be void, voidable, illegal or ineffective, this will not lead to the total ineffectiveness of the T&C. The provision in question will be replaced by a similar valid provision that takes due account of the intention and content of the same, in compliance with and in accordance with the regulations in force.
Any disputes that may arise will be referred to the exclusive jurisdiction of the competent court of Taranto.
PRIVACY MANAGEMENT BY INDIGO S.u.r.l.
We would like to specify that the data collected for order fulfillment and after-sales assistance, such as name and surname, residence and cardholder data used by users, (number, expiration date, security code) will be treated exclusively by inDigo Surl., with registered office in Corso Italia, 33 in Martina Franca (Ta), CF and VAT number no. 02516780737 as Data Controller. inDigo S.u.r.l. in fact it deals with the direct management of sales and transactions carried out in the context of the INDIGO Online Shop, for example order management, product sales and delivery, returns and guarantees management and other activities necessary for the sale of products through the INDIGO Online Shop.
According to the art. 7, d. lgs 196/2003, the relative rights can be exercised including consulting, modifying, deleting the data or opposing their treatment for the purpose of sending advertising material or for commercial communications or opinion polls, by contacting inDigo S.u.r.l. to the postal address indicated above or by sending an e-mail to: email@example.com. In the same way, it is possible to request the complete and updated list of data processors.
